Holland Conservation Commission

Minutes of Commission meeting held on May 23, 2006.

Present: Mary vandenBerg, Chairperson, Steven Anderstrom, Patricia Caron, Howard Fife, Ann Hall and James Wettlaufer. Absent: Rolf Hilbig.

7:00 p.m. Chairperson called the meeting to order.

7:05 p.m. Minutes of Commission Meeting held on May 16, 2006 were read, accepted and will be distributed.

7:08 p.m. Received from the DEP File #184-0202 assigned to Francis Gregoire’s project on Wales Rd.
Received from Green Hill Engineering a fax with a copy of Gordon Wiehler’s Recorded Order of Conditions.

7:10 p.m. Cheryl and Mike Martino brought in a copy of the receipt of their Recorded Order of Conditions.

7:20 p.m. Heather Blakeley presented the Procedure Sheet #2006-1082 issued to Christopher Mayor and Donna Brown of 157 Sturbridge Rd., Map 2-C-6 to install a 20’ x 40’ in-ground pool outside the 200’ Raparian Zone. Motion to approve project was made and approved by all. Procedure Sheet signed by Mary vandenBerg.

7:25 p.m. Mr. Christopher Wszolek came in response to a Certified Letter sent May 11, 2006 regarding the building of a shed adjacent to May Brook. He brought in pictures of his shed, which was demolished by the October flood. Since he was just replacing the 10’ x 15’ shed on piers, he did not think that he needed a permit and was apologetic for any grievances.

7:40 p.m. Peter Schartner’s Public Hearing of a Request for Determination of Applicability to install a tight tank at 44 Over The Top Rd. was held. Mr. Schartner’s Civil Engineer and Land Surveyor, Robert H. LeMaitre arrived a little late but was able to explain the project to the Board. Erosion controls to remain in place until re-growth has taken place. Motion to accept with a Negative Determination was made and approved by all. Public Hearing was closed at 7:50 p.m. Procedure Sheet was signed by Mary vandenBerg. A receipt was given to Peter Schartner for the $50.00 check paying for the Legal Ad.

8:00 p.m. David Buccelli spoke of his concern regarding a tree having been taken down in the right-of-way between 27 and 29 Shore Dr. without a permit. He brought in his deed, which gives him the right of access to the lake and has sought his other neighbors on Mashapaug and Ardmore to petition the removal of the wire fence that was installed in the right-of-way on Saturday, May 20, 2006 by the property owner of 27 Shore Dr. He would like a tree planted to replace the one that was cut.

8:15 p.m. Members signed:
1) The Vendor Voucher ordering $50.25 for stamps;
2) Order of Conditions for Christopher Batista file #184-0200, and
3) Judith and Charles Petit, file #184-0201.
Kristin LaPlante notarized the signatures.

8:20 p.m. David Joy, II and Alfred (Sonny) Boudreau, contractor came in response to the Certified Letter sent on May 11, 2006 regarding the removal of trees and soil within the Watershed at 2 Stony Hill Rd., Map R-35-F-16 and 8. Sonny Boudreau is raising the house and putting in a foundation. They both agreed to put in a silt fence below where a wall is to be built.

8:30 p.m. Mark Farrell and Gerald Joyal were present at the Joyal’s Public Hearing of a Request for Determination of Applicability to install a holding tank at 13 Massaconnic Trail, Map R-7-A-09 and removal and re-construction of an addition. They were informed that the addition has to be built on piers, since the property is in the 100-year flood zone. All were in agreement. Motion to accept with a Negative Determination was made and approved by all. Public Hearing was closed at 8:40 p.m. Procedure Sheet was signed by Mary vandenBerg. A receipt was given to Mark Farrell for the $50.00 check paying for the Legal Ad.
8:50 p.m. Brian Kaitbenski, Jeff Flannery of 18 Craig Rd., Map R-21-A-10 were represented by Mark Farrell of Green Hill Engineering to resolve the Conservation issues regarding his project of a septic system. The plot plan shows hay bails in place, a trench to catch any run-off and the creation of a graduated slope that is being back-filled. Mr. Brian Kaitbenski was reminded that he can-not remove any more than 300 cubic yards of sand in a residential zone

Motion to adjourn made by Ann Hall, seconded and approved by all. Meeting adjourned at 9:10 p.m.
